The German government aims to double the share of renewable energies in the electricity mix by 2030. Wind power in particular plays an important role in this context.
The Fourth Act Amending the Federal Nature Conservation Act (BNatSchG) in 2022 created a series of new regulations in the field of wind energy planning.
Assistance with planning and approval procedures
The aim of the study was to explain the legislative changes for practical work and, as far as possible, to specify them in concrete terms.
The study thus provides assistance with planning and approval procedures in order to accelerate the expansion of onshore wind energy while ensuring the protection of endangered and protected species.
Comprehensive information on current topics relating to wind power expansion
The multitude of current topics that are generally dealt with in terms of legal and species protection law include, among others:
- The legal classification of the new Federal Nature Conservation Act (BNatSchG) regulations on the reasonableness of protective measures
- The consideration of species protection issues in the designation of wind energy areas at the regional planning level
- The examination of legal and technical issues relating to the EU Renewable Energy Directive (RED).
